Partner Visa Subclass 820 Australia: Fees, Eligibility and Process for Indian Applicants (2026)

 Key Takeaways

  • Who it is for: spouses and de facto partners of Australian citizens, permanent residents and eligible New Zealand citizens who are already in Australia.
  • Fee from 1 July 2026: AUD 11,710 for the main applicant. One payment covers both the temporary 820 and the permanent 801 stage.
  • Processing time: published 2026 data puts the median for the temporary stage at roughly 17 to 20 months, with many files taking 24 months or longer.
  • Rights on the visa: live, work and study in Australia without employer or course restrictions, and enrol in Medicare.
  • Path to PR: the permanent Subclass 801 is assessed two years after you lodged. You must start that assessment yourself in ImmiAccount.
  • Applying from India? The 820 is not available offshore. The equivalent visa for applicants outside Australia is the Subclass 309/100.

What Changed for the Partner Visa 820 in 2026

2026 update

What it means for you

Fee increase on 1 July 2026

The main applicant charge rose from AUD 9,365 to AUD 11,710, an increase of about 25%. Applications lodged before 1 July 2026 stay on the old fee.

Dependant charges also rose

Each additional applicant aged 18 or over now costs AUD 5,860. Each child under 18 costs AUD 2,935.

2026–27 planning level

The government set 41,500 partner visa places for 2026–27, up from 40,500. The category is demand driven, so the figure is indicative and not a hard cap.

Home Affairs processing update (April 2026)

Case officers will not routinely send follow-up requests for missing documents. An incomplete file can be decided on what is in front of the officer.

Permanent stage reminder (April 2026)

The 801 assessment does not start automatically. After two years you must submit the permanent stage information through ImmiAccount.

Bridging Visa B charge

The fee to travel while on a bridging visa rose from AUD 190 to AUD 575 on 1 July 2026.

Long-Term Relationship in Visa 820 (Partner Visa – Temporary)

If you are applying for the  Subclass 820 Partner Visa and you are in long-term relationship with your partner, you may be eligible for faster processing or even direct grant of the permanent Subclass 801 visa, skip the usual 2 year waiting period.

A long-term relationship is usually defined as:

  • At least 3 years of living together in a de facto or married relationship, or

  • 2 years, if you have a child together.

You must provide strong evidence of your relationship duration and nature, including joint financial records, shared living arrangements and emotional and social commitments. If the Department of Home Affairs is satisfied that your relationship meets the long-term requirement, both temporary and permanent visas may be granted together.

Partner Visa Subclass 820 Eligibility Requirements

Eligibility has two sides. The applicant must meet the visa criteria, and the sponsor must be allowed to sponsor. A refusal can come from either side.

Applicant checklist

  • You are in Australia when you apply, and in Australia when the 820 is decided.
  • You are married to, or in a de facto relationship with, an eligible sponsor.
  • Your relationship is genuine, continuing and exclusive of all others.
  • You are 18 or older. Limited exceptions exist for married applicants aged 16 or 17 with the required approvals.
  • You hold a substantive visa, or you can meet the Schedule 3 criteria if you do not.
  • Your current visa does not carry a “No Further Stay” condition, or you have a waiver.
  • You meet the health and character requirements.
  • You have no unpaid debt to the Australian Government, or you have a repayment arrangement in place.

Sponsor requirements and sponsorship limits

Your partner must be an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen, and aged 18 or over. The sponsorship obligation lasts two years from the grant of the 820.

Sponsors also face limits that many couples only discover after paying the fee:

  • A person can generally sponsor no more than two partners in a lifetime.
  • There must be a gap of at least five years between two sponsorships.
  • A person who was sponsored on a partner visa usually cannot sponsor a new partner within five years of their own application.
  • Sponsors are asked for police certificates. Certain serious offences, especially those involving children or violence, can block the sponsorship.

Waivers exist for compelling circumstances, such as a long relationship or children together. They need strong evidence and should be argued at lodgement.

Married applicants

Your marriage must be valid under Australian law. A marriage that is legally valid in India is normally recognised, provided both people were of legal age, gave real consent and were not married to anyone else.

For Indian couples, a registered marriage certificate issued under the Hindu Marriage Act or the Special Marriage Act is the core document. A temple or gurdwara certificate alone is usually not enough, so register the marriage before you apply.

Eligibility Criteria for Subclass 820 Partner Visa (Temporary)

  • You must be in Australia when you apply and when the visa is granted

  • You must be in a genuine and ongoing relationship with an eligible sponsor

  • You and your partner must both be at least 18 years of age

  • Your partner must be an Australian citizen, permanent resident, or eligible New Zealand citizen

  • Your partner must agree to sponsor you for at least 2 years

  • You must hold a valid visa at the time of application

  • You must meet health requirements

  • You must meet character requirements, including police clearance

  • You must not have had a visa refused or cancelled while in Australia (with some exceptions)

  • You must not owe any debt to the Australian Government from a previous visa

De Facto Relationship

A de facto relationship means you and your partner are living together as a couple on a genuine domestic basis, similar to a married couple, but without being legally married.

For the Subclass 820 Partner Visa, a de facto relationship must meet the following key conditions:

  • You have been in the relationship for at least 12 months before applying

  • You live together, or do not live apart on a permanent basis

  • Your relationship is exclusive, committed, and genuine

  • You share financial, social, and emotional aspects of life

  • You can provide evidence like joint bank accounts, shared bills, rental agreements, or photos

If you haven’t lived together for 12 months, you may still be eligible if you have registered your relationship in an Australian state or territory.

Documents Checklist for the 820 Visa

Upload clear colour scans, name each file sensibly and place it in the correct ImmiAccount category. Since April 2026 the Department has stressed that poorly organised uploads slow a case down.

FAQs

Yes. The Subclass 820 is an onshore Partner visa and applicants generally need to be in Australia when they apply. The Department also states that applicants must be in Australia when applying, and family members applying with them must also be in Australia.

It depends on the condition attached to your current or previous visa. If your visa has a condition that prevents further stay, such as condition 8503, you may need to obtain a waiver before applying for the Subclass 820.

Potentially, but your current visa conditions and immigration history matter. In particular, you need to check whether your visa contains a condition that prevents you from making a further substantive visa application in Australia.

If you hold a Subclass 820, you are generally eligible for assessment for the permanent Subclass 801 two years after you first applied for the combined temporary and permanent Partner visas. You can check the relevant application date through ImmiAccount.

Yes. The Subclass 820 allows the partner to live in Australia temporarily and provides work rights, subject to the visa conditions attached to the grant.

Yes. A Subclass 820 holder can study in Australia, subject to the applicable visa conditions.

Ending a relationship does not automatically mean that every applicant loses the possibility of obtaining permanent residence. There are specific circumstances in which an applicant may still be eligible, including certain family violence situations and other circumstances recognised under the Partner visa provisions.

Processing times vary and there is no guaranteed individual processing timeframe. The Department’s July 2026 median for the broader Partner (Provisional/Temporary) category was 23 months, but individual applications can take longer or shorter depending on circumstances, completeness and processing priorities.

The Subclass 820 is the temporary stage of the onshore Partner visa pathway. You remain on the temporary Partner visa while you become eligible for assessment for the permanent Subclass 801 visa. Generally, two years must have passed since you applied for the combined 820/801 application before you become eligible for the permanent-stage assessment.

Eligible family members can apply with the main applicant where the relevant requirements are met. However, if a child needs to be added after the Subclass 820 has already been granted, they cannot simply be added to that temporary application. The Department states that a dependent child may instead need to apply for a Dependent Child visa (Subclass 445) before being included in the permanent Partner visa application.
